Good news for mediation coming from the UK Courts. In a recent decision in the Court of Appeal in the UK, Lord Justice Briggs decided that silence in the face of two requests to participate in mediation was sufficient to warrant a costs sanction. One has to wonder when or if Irish Judges will follow suit with this type of decision. Given the importance of UK Court decisions to Irish law making, it does suggest that anyone planning to sue in an Irish Court (or defending themselves) should seriously consider participation in mediation as part of their overall resolution strategy. It’s not such a bad thing really, given that mediation offers you an 80% chance of getting a settlement, will save you money and time, and gets rid of the stress and the uncertainty.
