In its Expendable Report 2013, which examined Public Expenditure on Legal Services, the Irish Government Economic & Evaluation Services stated that strategies to avoid, minimise and/or recover legal costs can be achieved by use if ADR techniques and especially Mediation.
The EU has placed mediation on a sound legal footing and there is general recognition across Europe and in the US that many cases would be more suitable to resolution by mediation than by litigation.
The service providers are generally cheaper, the process itself is more timely, and requires less time intensive on expensive procedures. The solutions it provides are more durable, the parties more satisfied with the outcomes and there is no drain on court services.
